NASA Images Download Terms and Conditions

The following is a legal agreement ("Agreement") between you and the Internet Archive (the "Archive"). The Archive offers these images from the collections of the National Aeronautics and Space Administration (NASA) under an agreement with NASA. This Agreement governs your use of the images on the NASAIMAGES.ORG website and is between you and the Archive for the benefit of NASA. If you do not agree with these Terms and Conditions, you should not download or use the images on NASAIMAGES.ORG.

Use of the NASAIMAGES.ORG site is governed by the PRIVACY POLICY , which is hereby incorporated by reference. If you use the NASAIMAGES.ORG site, you are accepting the terms and conditions of our Privacy Policy. If you do not agree to have your information used in any of the ways described in the Privacy Policy, you must discontinue use of the NASAIMAGES.ORG site.

The NASA imagery offered on NASAIMAGES.ORG is generally not copyrighted. You may use this NASA imagery for educational or informational purposes, including photo collections, textbooks, public exhibits and Internet Web pages (personal or otherwise). This general permission does not extend to any use of the NASA insignia logo (the blue "meatball" insignia), the retired NASA logotype (the red "worm" logo) and the NASA seal (the "NASA Properties") whether or not used in conjunction with images obtained from NASAIMAGES.ORG. Notwithstanding the foregoing restriction, you may use the NASA name and the NASA initials only as indicators of the original source of the NASA imagery.

A credit line should be used in connection with the images and should read "NASA/courtesy of nasaimages.org."

If the NASA images obtained from NASAIMAGES.ORG are used for commercial purposes (including advertisements or packaging), such use may not suggest, either explicitly or implicitly, that NASA endorses any commercial goods or services.

Downloading and using images from NASAIMAGES.ORG does not grant you any ownership right in the image(s) and you must not claim rights in the images.

Since neither NASA nor the Archive requires a written model release for each image that has identifiable people in it, we cannot guarantee that you will be able to use such images for any purpose you like. Therefore, if a NASA image obtained from NASAIMAGES.ORG includes an identifiable person, use of the image for commercial or other purposes may infringe that person's right of privacy or publicity, and permission should be obtained from the person depicted in the image. Any questions regarding use of any NASA image or the NASA Properties should be directed to:

Although both NASA and the Archive have taken efforts to ensure that only non-copyrighted images are included on the NASAIMAGES.ORG site, neither NASA nor the Archive represents or make any warranties that all images are free of third party rights.

If you believe that your copyright has been violated by material available through the NASAIMAGES.ORG website, please provide the Archive Copyright Agent with the following information:

Identification of the copyrighted work that you claim has been infringed;

An exact description of where the material about which you complain is located within the Internet Archive collections;

Your address, telephone number, and email address;

A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the owner of the copyright interest involved or are authorized to act on behalf of that owner; and

Your electronic or physical signature.

The Archive may immediately terminate this Agreement and your use of the NASAIMAGES.ORG site at its sole discretion at any time. The Archive may modify this Agreement from time to time, and your continued use of the NASAIMAGES.ORG site constitutes your acceptance. The Archive will attempt to notify you of substantial modifications via the email address you have registered with us, if any.

You expressly agree that use of the NASAIMAGES.ORG site is at your own sole risk. The NASAIMAGES.ORG site is provided on an "as is" and "as available" basis. The Archive and NASA expressly disclaim all warranties of any kind, whether express, implied, or statutory, including, but not limited to, the implied warranties of merchantability, fitness for a particular use or purpose, title, and non-infringement. The Archive and NASA make no warranty that the NASAIMAGES.ORG site will meet your requirements, or that your use of the NASAIMAGES.ORG site will be uninterrupted, timely, secure, or error free. The Archive and NASA do not warrant, guarantee, or make any representations regarding the use or the results of the use of the NASAIMAGES.ORG site with respect to performance, accuracy, reliability, security capability, currentness or otherwise. The entire risk as to satisfactory quality, performance, accuracy, efforts and results to be obtained through the use of the NASAIMAGES.ORG site is with you. No advice or information, whether oral or written, obtained by you from the Archive and NASA or through the services shall create any warranty not expressly made herein.

You agree to indemnify and hold harmless the NASA and the Archive and its parents, subsidiaries, affiliates, agents, officers, directors, and employees from and against any and all liability, loss, claims, damages, costs, and/or actions (including attorneys' fees) arising from your use of the NASAIMAGES.ORG site or the images offered through the site. You agree that this Agreement is between you and the Archive and is governed by California law and that any suit arising from this Agreement will be brought in San Francisco, California, and you further agree that on the election and reasonable notice of either party any litigation shall be referred to arbitration pursuant to the California Code of Civil Procedure, ¤¤1280 et seq. In addition, you agree that should any provision in the Agreement be found invalid, unlawful, or unenforceable, that provision shall not affect the validity or enforceability of the remaining provisions.

Under no circumstances, including, without limitation, negligence, shall the Archive or its parents, affiliates, officers, employees, or agents be responsible for any indirect, incidental, special, or consequential damages arising from or in connection with the use of or the inability to use the NASAIMAGES.ORG site or the images contained on the NASAIMAGES.ORG site, including, without limitation, damages for loss of profits, use, data, or other intangibles, even if the Archive has been advised of the possibility of such damages. The aggregate liability of the Archive to you for all claims arising from or related to the NASAIMAGES.ORG site is limited to one hundred dollars ($100). Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above may not apply to you.

This Agreement, the Privacy Policy, and other policies posted on the NASAIMAGES.ORG site constitute the full and complete agreement between you and the Archive. NASA is an intended third-party beneficiary to this Agreement.
